Terms of Service for Bento

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you”) and Bento (“we”, “us”, or “our”) concerning your access to and use of our Services (as defined below). By accessing or using any of our Services, you agree to these Terms. If you do not agree, do not use the Services.

We may update these Terms from time to time. The “Last Revised” date reflects the latest version. Your continued use of the Services following an update constitutes acceptance of the updated Terms.

The information provided through our Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement. You access the Services from other locations at your own initiative and are responsible for compliance with local laws.

In these Terms:

  • Website: any website of ours that references or links to these Terms (e.g., bentobot.xyz).
  • Bot / App: any Discord application of ours that references or links to these Terms.
  • Services: our Website, Bot/App, and related offerings (including premium features, support, and events).
  • Data: any data/content/information (including personal information) owned, held, used or created by you (or on your behalf) that may be stored using, or processed by, our Services.
  • Discord: Discord Inc. and its related companies.
  • Discord Server: any public or private server within Discord.
  • Discord End User: you, as a user of Discord’s services under Discord’s terms.
  • Discord End User Data: data you provide to Discord through the Discord App/clients.
  • Discord API: the APIs Discord provides to developers, enabling access to Discord End User Data under Discord’s terms and policies.

You must also comply with Discord’s rules:

1) Eligibility & Accounts

  • Minimum age: You must meet the minimum age in Discord’s Terms.
  • Website account: You may sign in with Discord on the Website. You are responsible for your account, the security of your login session, and all activity under it.
  • Acceptance: Inviting the Bot to a server, using Bot features, or sharing a server with the Bot constitutes acceptance of these Terms.

2) Acceptable Use

You agree not to:

  • Violate applicable laws, Discord’s rules, or these Terms.
  • Scrape, crawl, or automate access to the Website or Services, or circumvent rate limits. If you need data access, contact us to discuss approved use or a potential external API.
  • Engage in spam, API abuse, attempts to game or farm XP, or otherwise interfere with the Services or other users.
  • Upload/transmit content that is unlawful, infringing, misleading, harmful, harassing, hateful, or otherwise objectionable.
  • Reverse engineer, decompile, or attempt to derive source code except to the extent permitted by law.

We may throttle, suspend, or terminate access at our discretion for violations or risk to the Services or users.

3) Privacy

Your use of the Services is subject to our Privacy Policy (see https://bentobot.xyz/privacy-policy). It explains what we collect (including Discord OAuth sign-ins on the Website), how we use it (e.g., XP without storing message content), retention, and your rights.

4) Premium, Billing & Refunds

  • Premium: Some features may require a paid subscription or sponsorship.
  • Processors: Payments are handled by Patreon and Ko-fi under their terms; we do not store payment card details.
  • No refunds: Unless we state otherwise in writing, we do not offer refunds for subscriptions or sponsorships. You may contact us to transfer an eligible premium subscription to another Discord Server where supported.

5) Intellectual Property & User Content

  • Our IP: We and our licensors retain all rights in the Services, including software, features, branding, and content.
  • Your content: To operate the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and perform content you submit via the Services (e.g., configurations, embeds) solely to provide and improve the Services.
  • Your responsibility: You must have the rights to any content you submit. We may remove content at our discretion.
  • Notice of claimed infringement: If you believe content on the Services infringes your IP, contact us with details (links/screenshots, proof of ownership, and your contact information). We will review and respond consistent with applicable law.

6) Open Source License (AGPLv3)

  • Software license: Unless expressly stated otherwise in the relevant source repository, the source code for the Website and Bot is licensed under the GNU Affero General Public License, Version 3 (AGPL-3.0), dated 19 November 2007.
  • Scope: The AGPLv3 governs your rights to copy, modify, and distribute the code, and requires offering the complete corresponding source to users who interact with the software over a network, as set out in the license.
  • Service vs. software: These Terms govern use of the hosted Services. They do not grant rights to the code beyond those provided by the AGPLv3 (or other applicable open-source licenses).
  • Source availability: The source code corresponding to the deployed versions of the Website and Bot is publicly available in our GitHub repositories, linked from our release notes and public Docker images.
  • Third-party components: The Services may include open-source components under separate licenses. Those licenses govern your use of those components.
  • Contributions: If you contribute code/content to our repositories, you agree that your contributions are provided under AGPLv3 (or any contribution terms stated in the repository).

7) Trademarks & Branding

“Bento”, associated logos, and other brand features used with the Services are not licensed under AGPLv3. You may not use our trademarks, names, or logos without our prior written permission, except for nominative fair use.

8) Modifications, Availability & Uptime

The Services may change or be discontinued at any time without notice, including security patches, added/removed functionality, or policy changes.
We strive for 99% uptime, but this is a goal, not a guarantee; we provide no SLA and may impose or modify rate limits.

9) Third-Party Services & Links

We rely on third-party providers to host and deliver the Services. This currently includes Hetzner (infrastructure/database hosting) and Cloudflare (security/CDN). We are not responsible for third-party sites, content, or services. Your use of third-party services is subject to their terms and policies.

10) Disclaimers

The Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, or error-free, or that data/results are accurate or reliable.

11) Limitation of Liability

To the maximum extent permitted by law, we and our affiliates/licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, or other intangible losses; or costs of substitute services, arising out of or related to the Services or these Terms, even if advised of the possibility of such damages.

If applicable law requires a cap on direct damages, our total liability for any claim arising out of or relating to the Services or these Terms shall not exceed the amounts you paid to us for the Services in the 3 months preceding the claim or €25, whichever is greater. Some jurisdictions do not allow certain limitations; in those cases, the limitations apply to the fullest extent permitted.

12) Indemnification

You agree to defend, indemnify, and hold harmless us and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, or your violation of these Terms or applicable law.

13) Termination

You may stop using the Services at any time. We may suspend or terminate your access immediately, with or without notice, for any reason, including violations of these Terms or risk to the Services/users. Upon termination, provisions that by their nature should survive (e.g., IP ownership, disclaimers, limitations of liability, indemnity) will survive.

14) Age Gate

The Services rely on Discord’s minimum age requirements. Do not use age-restricted features (e.g., NSFW) if you are under the applicable age in your jurisdiction.

15) Miscellaneous

  • Entire Agreement: These Terms constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
  • Severability: If a provision is found unenforceable, the remaining provisions remain in effect.
  • No Waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
  • Export Controls: You must comply with applicable export and sanctions laws.
